The following regulations govern the use of the service of the Internet website (hereinafter, referred to as the “Website”) that MATHS FOR MORE, S.L. (hereinafter, referred to as “MFM”) provides to its Internet users.

MFM has its registered address in Barcelona, Rambla de Prat 21, 1º-1ª, 08012 and Tax Identification Number (CIF) B-62019716, and is registered at the Mercantile Register of Barcelona, Volumen 31.935, Folio 108, Hoja B-211155.

The mere use of the Website attributes the condition of user of the Website (hereinafter, referred to as “User”) and implies the acceptation of all the terms and conditions included in the present Legal Notice.

INDUSTRIAL & INTELECTUAL PROPERTY RIGHTS
The entire contents of the Website, whether texts, images, sound, files, trademarks, logos, combination of colours, or any other element, its structure and design, the selection and form of the presentation of the materials included herein and the computer programs required to operate, access and use it, (hereinafter, referred to as the “Contents”) are protected by industrial and/or intellectual property rights owned by MFM or, where appropriate, its licensors. Such rights shall not be deemed Licensed to the User save to the extent strictly necessary for the correct use of the Website.

In particular, but without restricting the general obligation incumbent upon de User pursuant to the previous paragraph, it is forbidden to reproduce, transform, distribute, disclose publicly, make available to the public and, in general, in any other way exploit, through any process, the contents of the Website, in whole or in part, as well as their design and the selection and form of presentation of the materials included herein. These acts may only be carried out if MFM has previously granted its express authorization in writing and provided that express reference is made to the fact that MFM or its licensors are the owners of the intellectual property rights.

It is also prohibited to decompile, disassemble, reverse engineer, sublicense or transfer, translate or carry out in any way works derived from the computer programs required for the effective operation of this Website, for its access and use of the services contained herein, as well as perform, in relation to all or some of such programs, any of the acts referred to in the previous paragraph. The User of this Website should in any case refrain from deleting, altering, evading or manipulating any protection devices or security that may be installed herein.

The infringement of any of the abovementioned conditions could be a violation of the law and a criminal offence typified in article 270 and successive of the Spanish Penal Code.

TERMS OF USE

User and, in general, any legal or natural person who intends to provide a hypertext link or technical link device (such as, text links or buttons) from its website to the Website (hereinafter, referred to as the “Hyperlink”) shall require the prior written consent of MFM and comply with the following conditions:

The link shall connect with the Website’s main page and shall not reproduce it by any means (copy of the text, graphics, etc…).

It shall be forbidden, according to applicable laws, to establish frames around the Website or to allow the visualization of its Contents through Internet addresses different to the Website and when such visualisation: (I) creates or could create, error, confusion or misleadingness on the Users about the real source of the services or Contents; (II) constitutes a comparison act or an unfair imitation; (III) its used to take advantage of the trademark’s or brand’s reputation and prestige of MFM; (IV) in any other way, is forbidden by applicable laws.

No false or incorrect statements shall be made regarding MFM, its directors, employees or agents, its clients or the quality of its services and products in the webpage containing the Hyperlink.

The page establishing the link shall comply with applicable laws and it will not connect with third party contents that: (I) are unlawful and contrary to moral and decency; (II) imply the existence of any relationship between MFM and the owner of the site or webpage where the link is inserted, or the acceptance or approval by MFM of its contents or services; (III) are inappropriate according to MFM activities.

LIMITED LIABILITY
Under no circumstances shall MFM be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning, as well as Hacker’s attacks.

The Website makes available to the User, solely for the purpose of searching and accessing information, contents and services available on the Internet, Hyperlinks or technical link devices (such as, text links or buttons), which allow User to access Internet sites or portals which belong to or are managed by third parties (hereinafter, referred to as “Linked Sites”). MFM does not offer or commercialise on its own behalf or through third parties the information, contents and services available in the Linked Sites, nor does it approve of, supervise or control in any way whatsoever the contents and services or any material of any nature therein available. Thus, the User shall be exclusively responsible for the navigation between the said sites.

The User or its legal representative shall be responsible for limiting the access to rated Contents by minors through mechanisms that are available on the Internet browser or services provided by third parties.

MFM implements reasonable security measures which are adequate to detect the existence of viruses. Nevertheless, User declares to be aware that the existing security measures for computer systems on the Internet are not entirely trustworthy and that, therefore, MFM cannot guarantee the non-existence of viruses or any other elements that could cause alterations to User’s computer systems (hardware and software) or to the electronic documents and files contained in the said systems. Consequently MFM is not responsible for any loss, cost or damage that such elements could cause the User or third parties.

The User shall be responsible for all damages, costs and losses suffered by MFM as a result of the non-performance of its legal obligations.

DATA PROTECTION
In accordance with Organic Law 15/1999 of Personal Data Protection, MFM hereby informs the User of the existence of an automated file created and under the responsibility of MFM, containing the personal data that, given the case, is provided by the User during navigation through our Website, with the finality of managing the petition made by the User and for the purposes of sending commercial communications, including commercial e-mails.

MFM undertakes to comply with its secrecy obligations with regard to the personal data it collects, to conserve such personal data and to adopt the necessary measures to prevent such data from being altered, lost, processed or its unauthorised access.

With regard to the data submitted by minors, prior to its incorporation to the automated files, the obtaining by the sender of his/her parents, tutor or legal representative’s authorisation shall be required.

The User shall be responsible for the accuracy of the data provided. MFM has the right to exclude any User responsible for providing false data from the registered services.

The User shall be entitled to exercise the rights conferred under the law in relation with any personal data provided to MFM by means of the Website and, in particular, will be entitled to the right to access, rectify, cancel or oppose the data, if appropriate, as well as the right to revoke the consent to the transfer of such data. The User, or where appropriate its representative, may exercise these rights by submitting a written and signed request, addressed to: Maths For More, Rambla de Prat 21, 1º1ª, 08012 Barcelona (Spain), accompanying a copy of the national identification card, or passport of the User and, if applicable, any other document accrediting the representation of the User.

A “cookie” is a small piece of information that is sent by a web server to be stored on a web browser, so that it can later be read back from that browser the next time this unique visitor returns to that web server. This becomes useful for having the browser remember specific information about this visitor like location of their last visit, time spent, or user preferences (like style sheets). GOVERNING LAW AND JURISDICTION
These General Conditions shall be governed by Spanish Law.

The User and MFM agree that any dispute arising from the access or use of the Website shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of Barcelona capital, waiving any other general or specific forum which may be applicable.
